Gas Safety Regulation amended to allow “MOT-style” safety checks

New approach to conduct mandatory landlord gas safety records added to regulations on April 6 to ensure greater flexibility in ensuring timely compliance

The Association of Gas Safety Managers (AGSM) has welcomed new regulation that came into effect last week introducing an “MOT-style” approach with which landlords can undertake mandatory gas safety servicing in their properties annually.

The amendments have been introduced to the existing Gas Safety (Installation and Use) Regulation to allow for any servicing work required in a specific property to be completed up to two months before the anniversary of a previous check. This can be done without compromising the existing expiry date on a previous check at the property.

Regulation 36a, which has been backed by the AGSM and organisations such as CORGI Technical Services and Homegroup, is not compulsory, and is intended to ensure more flexible scheduling of the required annual checks of gas safety.

AGSM chief executive Claire Heyes has argued that the amendments were the result of collaboration with the Health and Safety Executive (HSE) to better meet legal requirement for landlord gas safety records to be carried out annually. It is also intended to provide great clarity for residents on when checks will be undertaken.

Ms Heyes added, “One of the biggest challenges our members face is gaining access to carry out the LGSR with a significant cost to the sector, so I was determined the AGSM would do all it could to help make improvements.”

“In response to this, we worked closely with the HSE on the benefits of the new MOT-style servicing scheme which is already being actioned by many of our member organisations. Working closely with our determined and dedicated members, we have taken the industry forward, and I couldn’t be prouder of our achievements.”

The amendments are intended to address concers about a reliance on a four or eight-week access process to carry out the required safety checks to minimise the need for repeat servicing within the required period.
